Terms and Conditions

  1. Information on how to enter forms part of these conditions. Participation in the WIN – Wine and Dine (“Competition”) constitutes acceptance of these Terms and Conditions.

    • Commences at: 5:00am (AEST) on Saturday 28 August 2021
    • Ends at: 11:59pm (AEST) on Friday 10 September 2021

Selection of Winner(s):

The prize winner(s) will be drawn at random on Monday 27 September 2021. Winner(s) will be contacted and be notified via email. When a prize winner is drawn, the winner(s) name(s) will be published on this website here, and on Daylesford Macedon Tourism’s Facebook account.

Participation in this Competition is only open to Australian citizens aged 18 years or over who reside in Australia.

Employees of the promoter (and their immediate families), or agencies or companies associated with or connected to the provision of the Competition in any way, are ineligible to enter.

The promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence), to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


  1. This Competition is a game of chance. The prizes will be given to 800 (eight hundred) individual entries as submitted to the Promoter’s competition.
  2. To enter, eligible persons must submit their details via this link – https://daylesfordmacedonlife.com.au/win-wine-dine/ including (but not limited to) name, phone number, postal and email address. By providing email details entrants are affording the Promoter and their prize partners permission to send updates and information post promotion.
  3. Entries must be received within the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
  4. Incomplete or indecipherable entries will be deemed invalid.
  5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence), to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  6. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
  7. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries by that entrant invalid.


  1. The Winner(s) will be drawn on Monday 27 September at 12pm, 2021
  2. The Winner(s) will be notified in writing via email.
  3. The Winner(s) will be required to provide a postal address to receive their prize.
  4. It is the responsibility of each Winner to notify the Promoter of any change to their contact details.
  5. All reasonable attempts will be made to contact the Winner(s). If the Winner(s) fail to respond to Daylesford Macedon Tourism’s email by 9:00am (AEST) Friday 8 October 2021, the Promoter will reserve the right to select an alternative Winner(s) (next best entry).
  6. Prizes will be issued to the Winner(s) in accordance with these conditions and subject to such confirmation.
  7. Prizes are not transferable and cannot be taken as cash. If a prize is unavailable, for any reason, the Promoter reserves the right to substitute the prize to the equal value and/ or specification.
  8. Prizes are to be redeemed only at participating businesses within one year from the date of prize draw unless otherwise stated.
  9. Prize values are based upon the individual gift card amount (inclusive of GST).
  10. It is the responsibility of the Winner(s) of the WINE AND DINE GIFT CARD: to cover the costs of any additional out-of-pocket expenses associated with redeeming this prize over and the gift card amount.
  11. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the Winner(s).
  12. Once a Gift Card has left the Promoter’s premises, the Promoter takes no responsibility for the Gift Card being damaged, lost or stolen.

Competition and Consumer Act 2010 and Limitation of Liability

  1. The Competition and Consumer Act 2010 (Cth), as well as other laws in Australia, may imply certain conditions, warranties and undertakings, and give you other legal rights.  If they apply, these cannot be modified or excluded by any contract.  You may consider seeking legal advice as to whether they apply to you.
  2. Nothing in these Terms and Conditions generally affects the entrant’s rights under Australian consumer law (as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and equivalent State and Territory fair trading legislation) regarding consumer guarantees to the extent that such consumer guarantees cannot be excluded by law.  Other than these consumer guarantees, the Promoter makes no warranties about any prizes offered as part of the Competition, including warranties as to the quality, merchantability or fitness for purpose of such prizes.
  3. While a permit isn’t required, all trade promotion complies with the conditions in the Gambling Regulation Act 2003 and Gambling Regulations 2015.
  4. The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or entrant; or (f) use of the prize.
  5. All claims and entries become the property of the Promoter. By entering the Competition, each entrant is taken as consent to the Promoter using the entrant’s personal information to administer the Competition, announce the Winner and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Competition and announcing the Winner, and to third parties as required by law (including authorities that regulate this Competition). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and its Privacy Policy is available at http://www.dmrtourism.com.au/privacy-policy. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.

Termination of Competition

The Promoter reserves the right to vary the terms of, or cancel, the Competition at any time without liability to any entrant or other person, subject to applicable laws.
